Scope of application
These Terms and Conditions of Sale detailed below apply, without restriction or reservation, to all product orders made via the Tapioca Bijoux website.
Each person (the Customer) wishing to purchase a product via our site must read the General Terms and Conditions beforehand and find out about the main characteristics and specifications of our jewelry (materials, dimensions, illustrations) presented on the Tapioca Bijoux website. The choice and purchase of a Product are the sole responsibility of the Customer.
Product offers are subject to availability of stock, as specified when placing the order.
Tapioca Bijoux reserves the right to adapt or modify these T&Cs at any time, so it is mandatory to read the latest version of the T&Cs currently online on our website tapiocabijoux.com before placing any order. Consequently, placing an order requires the Customer's full and unconditional prior acceptance of these T&Cs by clicking on the button "I have read and accept the general terms and conditions of sale".
By accepting these General Conditions of Sale, you confirm that you are over 18 years old or have obtained the authorization of your legal representative.

Tapioca Bijoux is an e-commerce site specializing in the sale of jewelry and accessories. The head office is located at 8 avenue papillon, in Messanges, France. The company is registered under Siret number 921 436 523 00036 in the Mont-de-Marsan Trade Directory. VAT not applicable, article 293 of the CGI.

tapiocabijoux.com is an online shopping site accessible to all users of the Internet. Tapioca Bijoux is not responsible for any interruption, scheduled or not, for the needs of its maintenance and/or security or in cases of force majeure. Tapioca Bijoux cannot be held responsible for any damage, whatever its nature, resulting from unavailability of the Site.
Tapioca Bijoux does not guarantee that the Site will be free of anomalies, errors or bugs, nor that the Site will operate without breakdown or interruption. In this regard, it may freely determine at its sole discretion any period of unavailability of the Site or its content. Tapioca Bijoux cannot be held responsible for data transmission, connection or network unavailability problems.
Tapioca Bijoux reserves the right to modify the Site for technical or commercial reasons. When these modifications do not alter the conditions of the provision of services, in a substantial and negative manner, the Customer may be informed of the modifications made, but his acceptance is not requested.
Orders
Ordering on our site is subject to compliance with the procedure set up by Tapioca Bijoux, comprising successive steps leading to the validation of the Order. The Customer may select as many Products as they wish, which will be added to the basket. Any order constitutes acceptance of prices and description of the products available for sale. Any dispute on this point will occur within the framework of a possible exchange and the guarantees mentioned below.
Product offers are valid as long as they are visible on the site, within the limits of available stocks.
The sale will only be considered valid after full payment of the price. It is the customer's responsibility to check the accuracy of the order and to immediately report any errors.
A confirmation email summarizing the Order (Product(s), price, availability of the product(s), quantity, etc.) will be sent to the Customer after validation of the order. To this end, the Customer formally accepts the use of email for confirmation of the content of his Order.
Customer information
You are responsible for the accuracy of the personal data you provide to us and for all purchases made using your login credentials on our site. Please ensure that you keep your login credentials secret and prevent unauthorized persons from accessing them.
Price
Prices are indicated on the website in euros, all taxes included (TTC). The products are supplied at the current prices appearing on the Tapioca Bijoux website, when the order is registered by the Seller. Prices include VAT and any discounts applicable on the day of the Order. We reserve the right to modify the prices of the items at any time. The price of the items invoiced is therefore that indicated when the Order is placed.
Prices do not include processing, shipping, transport and delivery costs which are charged in addition under the conditions indicated on the site and calculated prior to placing the order.
Also note that local fees (such as currency conversion fees, payment or credit card fees, sales taxes, customs duties, etc.) may apply, depending on the local regulations of your country of residence. These fees are your responsibility and will not be refunded by us.
An invoice is drawn up by the seller and given to the customer upon delivery of the products ordered.
Conditions de paiement
This is an order with payment obligation, which means that placing the order implies payment by the buyer.
The Order is payable immediately by credit card (CB, Visa, MasterCard) or by Paypal. The Customer guarantees the company Tapioca Bijoux that he has the necessary authorizations to use the payment method chosen by him, when validating the order form. The debit of purchases on the customer's account is done at the time of processing the order.
Tapioca Bijoux implements all necessary means to ensure the security and confidentiality of data transmitted online via the Stripe payment service, which alone has the banking information provided on the site at the time of payment.
In certain cases, including non-payment, incorrect address or other problem with the buyer's account, the seller reserves the right to block the buyer's order until the problem is resolved.
Delivery of the order
Our jewelry is created by the hands of its sole creator, on request. The maximum shipping time is therefore 10 working days, although orders are generally sent out faster.
Orders are delivered by La Poste.
Standard delivery costs €3.50.
Standard delivery is free for orders over €60.
Colissimo delivery within Europe costs €7,20.
We cannot be held responsible for delays caused by the carrier. In the event of lost or damaged parcels or non-delivery, we invite you to make a claim with La Poste.
Withdrawal & return rights
In accordance with article L.121-20 of the French Consumer Code, you have a period of fourteen clear days to exercise your right of withdrawal without having to justify your reasons or pay any penalties, with the exception of return costs. The period mentioned in the previous paragraph runs from receipt of the goods. Products must be returned to us immediately in their original condition, never worn or put under water.

Any item that appears to have been worn or damaged will be refused. You are responsible for the condition of the products during their return. We therefore recommend that you send them well-packaged, with a copy of the invoice, in their original packaging. Please give us the tracking number once the parcel has been posted.
Personalized orders do not fall under the right of withdrawal and cannot be returned for refund or exchange.

As soon as we receive your order, we will reimburse you within 15 days of the date on which the return was received and if all the conditions mentioned in the return procedure are met.
Disclaimer
We reserve the right to make errors on our website, such as errors in images or typographical errors, in particular errors in product descriptions or technical specifications, inaccurate prices or incorrect information concerning the availability of a product in stock. We are entitled to correct any obvious errors and to amend or update the information published on the website accordingly at any time.
The images on the website are for illustrative purposes only and do not constitute a guarantee of the exact number of products you may receive by placing an order, nor of the exact appearance, function or origin of the products.
Warranties and claims
All our jewelry is guaranteed for 1 month after purchase. You can therefore return broken or damaged jewelry within this period. The order confirmation constitutes the warranty certificate. Our warranty only covers original construction defects, and therefore does not cover defects that appear during or after modifications to the function or appearance of the products, such as rebuilding, upgrading or any other configuration of the products.
You have the right to make claims concerning products considered defective immediately upon receipt of the products. You must then inform us of your complaint by e-mail to tapioca.bijoux@gmail.com, indicating your name, physical address, e-mail address, order number and a description of the products that are the subject of the complaint. Complaints must be made as soon as possible after discovery of the defect. Any complaint made within one month of the discovery of the defect will always be considered to have been registered within the time limit.

In the case of defective products, we will reimburse you in accordance with the applicable consumer protection legislation and cover the cost of returning the products. We aim to issue these refunds within 30 days of receipt of the product complained of. Refunds will be made using the same method of payment that you used to pay for the order of the products concerned by the complaint, unless otherwise agreed.
Force majeure
Toute circonstance indépendante de la volonté des parties empêchant l’exécution dans des conditions normales de leurs obligations, notamment de livraison, sont considérées comme des causes d’exonération des obligations des parties et entraînent leur suspension. Sont considérés comme tels, notamment, sans que cette liste soit limitative, la guerre, les émeutes, l'insurrection, les troubles sociaux, les grèves de toutes natures. Le vendeur informera les clients de la survenance d'un cas fortuit ou de force majeure dans les sept jours de sa survenance. Au cas où cette suspension se poursuivrait au-delà d'un délai de quinze jours, le client aura la possibilité de résilier la commande en cours, et il sera alors remboursé du prix des Produits commandés et des frais de livraison payés.

Lois applicables et juridictions compétentes
Les Conditions Générales de Vente sont soumises au droit français. Seule la version française des présentes Conditions Générales de Vente fait foi. En cas de difficulté survenant à l'occasion de la commande, de la livraison des produits et plus généralement de l'exécution de la vente, le client aura la possibilité, avant toute action en justice, de rechercher une solution amiable, notamment avec l'aide d'une association de consommateurs ou de tout autre conseil de son choix.
La langue des présentes Conditions Générales et des commandes acceptées est la langue française. En cas de litige, les tribunaux français seront seuls compétents.
